General terms and conditions

These terms and conditions govern the business relationship between Studio Hanselmann, Sven Hanselmann, Haldenhof 3, 9000 St. Gallen, Switzerland and the client of a wedding report. They supplement the individual service contract, which they do not replace. According to Swiss law, terms and conditions must be accepted transparently, fairly and before the contract is concluded in order to become effective. Individual agreements always have priority.
1. Scope
These conditions apply to all wedding photography and videographic services offered by Studio Hanselmann. By booking or concluding a contract, you accept these terms and conditions as binding. Terms and conditions in Switzerland are not mandatory; they are for clarity and prevent misunderstandings.
2. Conclusion of contract
A contract is created as soon as one of the following acts takes place:
- a written order confirmation via email
- Signing a service agreement
- Payment of the agreed deposit
The parties agree that electronic communication (email) as a written form is sufficient.
3. Services provided by the videographer
Studio Hanselmann undertakes to photographically and, if necessary, videographically accompany the wedding on the agreed date. Services include:
- Support in accordance with the offer, including preparations and reports
- Selection and basic processing of images, such as color correction, exposure and cropping
- Provision of images as JPEG and videos as MP4 via a password-protected online gallery
The number of images and the photographic style are determined together. The photographer reserves artistic freedom in order to create a coherent report.
4. Delivery time and data backup
The edited images are generally provided within fourteen calendar days after the wedding day, unless otherwise agreed. Videos are generally delivered within two months. The data is stored on servers in Switzerland and on external data carriers. Permanent archiving beyond that cannot be guaranteed. We recommend that you download the submitted gallery within thirty days and save it yourself.
5. Fees and terms of payment
The fee is based on the individually prepared offer or the service contract. Unless otherwise agreed, the following applies:
- Down payment of fifty percent upon conclusion of the contract to reserve the appointment
- Final payment no later than fourteen days before the wedding
- If payment is made in full within ten days of signing the contract, a discount can be granted
All prices are in Swiss francs, including agreed expenses. In the event of late payment, interest on arrears and reminder fees are charged in accordance with law. The appointment will only be definitively reserved upon receipt of the deposit.
6. Rights of use
The photographer remains the author and retains all rights to the images and videos. The bridal couple receives an unrestricted right of use for private purposes. These include, for example:
- Prints and photo albums
- private online galleries
- Social media publishing
Commercial use, editing beyond basic retouching, transfer to third parties or sale is not permitted without the photographer's written consent. The photographer does not provide any raw data (RAW). If the bridal couple publishes pictures of guests, it is the responsibility of the client to obtain consent. The consent to publication can be withdrawn at any time.
7. Photographer's self-promotion
Studio Hanselmann may use selected images and videos for its own website, portfolio, social media appearances or competitions. Sensitive content is used respectfully and discreetly. Couples can object to this use at any time in writing, for example by email.
8. Cancellation and Withdrawal
The deposit is used to make a reservation and covers administrative expenses. In the event of a cancellation by the bridal couple, the following rules apply:
- Up to thirty calendar days before the wedding date, the deposit will be refunded in full
- later than thirty days before the appointment, the deposit will be withheld
- The full fee is due less than seven calendar days before the wedding
The deadlines are required as no alternative dates can be accepted shortly before the event. The regulations do not apply in the event of proven force majeure as described in Section 9. If Studio Hanselmann finds an equivalent replacement booking at short notice, the deposit can be refunded proportionally.
9. Force majeure and rescheduling
If the wedding is postponed or cancelled due to unforeseeable events such as natural disasters, pandemics or official orders, we will endeavour to reschedule the date by mutual agreement at no additional cost. If the photographer is unable to attend the new date, the deposit will be refunded.
10. Substitute provision
In the event of illness or unforeseen failure of the photographer, Studio Hanselmann will arrange an equivalent replacement if possible. If no replacement can be provided, payments already made will be refunded in full. Further claims are excluded.
11. Liability
The liability of the photographer or videographer is limited to intentional or grossly negligent conduct. No liability is assumed for technical defects, loss of data, damage due to force majeure or indirect damage. A complete exclusion of liability is not permitted under Swiss law; liability therefore persists for damage due to intent or gross negligence. In any case, the amount of liability is limited to the fee already paid.
12. data protection
Personal data, in particular contact details, event details and images, are kept confidential. Processing is governed by Swiss Data Protection Act and our separate privacy policy, which you can access at any time on our website. Data subjects have the right to access, correct and delete their data in accordance with law.
13. Final provisions
Amendments or additions to these terms and conditions must be made in writing. An email is sufficient. Should individual provisions be ineffective, the validity of the remaining provisions remains unaffected. Unusual or surprising clauses are clearly highlighted so that they do not violate the abnormality rule.
14. Applicable Law and Jurisdiction
Swiss law is exclusively applicable. The exclusive place of jurisdiction is St. Gallen, unless mandatory law provides for another place of jurisdiction.
